» Print This PageFelonies are very serious crimes, usually involving violence, where Texas law has imposed harsh punishments: felony sentences are usually for imprisonment for a number of years or for life (with or without parole). Felony convictions under Texas law sometimes include the death penalty sentences.
Federal law also defines certain crimes to be felonies. The death penalty, or capital punishment, is also possible under federal law for certain felonies such as murder related to the smuggling of aliens (8 U.S.C. 1342) and murder committed during a drug-related drive-by shooting (18 U.S.C. 36).
Since felony convictions have such harsh punishments, the law has provided protections to insure that the criminal process is fair and that justice is served. These include constitution protections, such as the Sixth Amendment requirement that a felony defendant can have the assistance of an attorney, and the Fifth Amendment right to not incriminate oneself (you do not have to testify against your own interests).
